[Q&A] Latest Update of Foreign Experts Policies during the Novel Coronavirus Outbreak


新冠肺炎病毒疫情爆发将近两个月了,每日新增病例下降,这与政府的有效措施以及大家的积极配合密不可分。当然,在这段期间,您或许遇到了诸多不便。为此,上海市政府有关部门出台了很多便捷措施。现在,就让小编为您送上这份小贴士,希望能对大家有所帮助。

The outbreak of the novel coronavirus epidemic has lasted for almost two months. Now the number of new cases in China is decreasing steadily, which would be impossible without effective measures taken by the government and full support from each and every one. We understand that it might bring you so much inconvenience during this period of time. To give you a support, authorities in Shanghai have streamlined some administrative processes relating to foreigners’ work permit, visa, and Shanghai Health QR Code. Now let me give you some tips as follows, hoping they are helpful to you.

 

Q1. 某学院:我们学院春季学期新聘请了一名外国专家,现在要为他申请来华工作许可,请问现在我们还需要去人才大厦交材料吗?

对外合作交流处:不需要哦~自20202月起,上海市外国专家局把工作许可在线办理的范围暂时进行了拓展,外国专家(B类)的工作许可通知、延期等业务也可以在线办理,以避免人群聚集和交叉感染。

此外,本周二(310日),上海市外专局进一步简化了疫情期间的行政流程,主要便利措施如下:

1. 超过65岁的高端外国专家来华不必提交国际保险和相关材料;

2. 注销外国专家工作许可的审批时间从10个工作日缩短为3个工作日;

3. 如果需要解除双方劳动关系,而外国专家无法在相关证明上签字,可上传双方往来邮件、微信聊天记录等材料作为证明;

4. 暂时取消“延期业务须在许可届满前 30 日提交”的限制,用人单位可在许可届满前在线提交;

5. 若外国专家的签证或居留许可到期且未出境,可以在出入境管理部门规定的自动顺延期限内办理外国人来华工作许可。

Q1. X School: We are applying a Work Permit for a newly employed foreign expert. Do we have to go to the Shanghai Administration of Foreign Experts Affairs in person to hand in the paperwork?

Office of International Cooperation and Exchange: No need to do so. Since February 2020, the Shanghai Administration of Foreign Experts Affairs (SAFEA) temporarily has expanded online work permit applications to more foreign employees (Type B), which was only available for top foreign talents (Type A). Instead of handling paperwork and visiting windows, you can apply online for work permit notification letters, as well as for the extension of work permits, which avoids gatherings and prevents the risk of cross-infections.

Moreover, on Tuesday of this week (March 10th), SAFEA further streamlined the administrative process by releasing some new policies. The key points are listed as below.

1. Top foreign talents over 65 years old don’t need to submit the international health insurance policy and related documents.

2. It requires only 3 business days (previously 10) for authorities to deal with employers' applications to cancel the work permits of foreign experts.

3. During the epidemic, online evidence, such as e-mail and WeChat records, are admissible if foreign experts are not able to sign their names on termination of employment paperwork.

4. SAFEA has temporarily abolished the requirements that employers need to apply for work permit extensions of foreign experts 30 days prior to expiration.

5. Foreign experts who stay in China with an automatically extended visa can apply and extend their work permits.

Q2. 外国专家:我现在在上海,但签证320日就要到期了,现在学校还未开学,请问我现在该怎么办呢?

亲,不用担心。根据国家移民管理局发布的最新政策,疫情期间,在华外国人如果签证到期,可以自动顺延两个月,无需前往出入境管理局办理手续。上海市出入境管理局正常办公,以满足紧急需求。但如无必要,请尽量居家,避免外出。

Q2.Foreign Expert: I am in Shanghai. My visa will expire on March 20th, but the University is still closed. What am I supposed to do now?

Office of International Cooperation and Exchange: Don’t worry. According to the latest policy issued by the National Immigration Administration (NIA), during epidemic period, the visas of foreigners will be automatically extended for 2 months, which means foreigners staying in China don’t need to go to the visa office in person to renew visas even if they are going to expire. Visa offices of Exit-Entry Administration (EEA) in Shanghai are still open for those with urgent needs. However, it’s strongly recommended that you stay at home and avoid heading out.

To avoid crowds gathering risks, we also recommend that our foreign experts complete residence registration online upon your arrival in Shanghai rather than go to the police station in person. Here is a step-by-step guide of the online registration:

Q3. 外国专家:

我最近听说有个叫“随申码”的东东,那个是什么?我需要吗?怎么申请呢?

对外合作交流处:

如果您在上海或将要返回上海,建议您申请“随申码”,因为这是您的健康证明,进入上海和使用很多公共设施时都会要求提供。随申码还会继续推广到办公楼、工厂、科技园、各级行政服务中心等公共空间,以省去额外的健康证明文件。

已通过支付宝实名认证的用户可以直接申请(路径:支付宝-城市服务-随申码)。

微信也有类似的申请入口(路径:微信--微信支付-随申码)。

 

Q3. Foreign Expert: I heard recently that there is some “code” Shanghai residents are applying and using. What is that? Do I need to apply? And how?

Office of International Cooperation and Exchange: If you are in Shanghai or will come to Shanghai, please apply for a Shanghai Health QR Code (随申码), which equals to a health declaration. It is a necessity for your entry of this city and access to most utilities. The code will be expanded to cover more office buildings, factory sites, technology parks and administration service centers at all levels as well as all public spaces, so there would be no need for extra paperwork.

Those who have already completed identity verification by Alipay (支付宝) can apply directly for a code (Route: Alipay- City Service- 随申码).

There is a similar application entrance in the WeChat (Route: WeChat- Me- WeChat Pay- Anti-Virus Code).
